US regulatory enforcement has entered a period of unprecedented uncertainty. Preexisting norms and previously unquestioned institutional and regulatory structures are now subject to doubt. Career Justice Department lawyers must navigate what this means for their investigative and enforcement duties and compliance professionals are left to guess at the outcome for their clients. Across the body of US law, nowhere is this new uncertainty more pronounced than in the enforcement of federal anticorruption statutes, in particular the Foreign Corrupt Practices Act.

For decades corporate anticorruption laws generally - and the US FCPA in particular - only increased in importance as an area of legal practice and the subject of international and intergovernmental organization scrutiny. But the Executive Order passed on February 10, 2025 suspending enforcement of the FCPA for at least six months while the Attorney General reviews current guidelines and enforcement actions and reissues new guidance has turned the world of anticorruption enforcement and compliance on its head.

This course will examine the global phenomenon of corruption and the existing legal and voluntary frameworks under both US and international law to govern it in light of recent developments. The course will focus primarily on corporate corruption with a comprehensive study of the FCPA, related decisions, enforcement actions and enforcement agency guidance, but will focus specifically on the role of the in-house counsel and compliance professional in reducing potential liability risks under the law given current regulatory uncertainty.

This course meets on a condensed schedule over three consecutive days.

-The Registrar’s Office will drop a student who does not attend each course session.
