This course explores the law governing lawyers with a primary focus on the ABA Model Rules of Professional Conduct and a secondary focus on selected California rules. Our primary reading will be Ethical Problems in the Practice of Law by Lerman et al. This coursebook has been selected because it provides an accessible discussion of the law governing lawyers and ethical issues. Class discussions will amplify the material in the text. Together we will work through hypothetical scenarios, exploring what guidance exists, where there are gray areas and how to develop a framework for resolving issues with no clear answer. On occasion, a case, article, or podcast will also be assigned. Students are also strongly encouraged to acquire a copy of the ABA Model Rules (2023 Edition). This course is interactive and requires participation in the form of class discussion and small-group exercises. For this reason, regular attendance is expected. Ten percent (10%) of the final grade will be determined by class participation.

Ms. Bomse is a litigator in private practice. Her practice focuses on the law of lawyering. She represents lawyers, law firms and clients in a wide variety of disputes involving professional negligence, fiduciary duties and breach of contract as well in disciplinary matters before the State Bar. She also counsels and advises lawyers and law firms concerning risk management and legal ethics
