Standard courses in constitutional law teach the “tiers of scrutiny.” Under this theory, fundamental rights and equal protection are subject to a balancing test–weighing the right at issue against the state’s interest in infringing it. Is this the right approach, and is this the future of constitutional interpretation? Join us for a conversation with Professor J. Joel Alicea of the Catholic University, Columbus School of Law. Lunch will be provided. Presented by the Public Law & Policy Program and the Federalist Society, Berkeley Chapter.
