Abstract
Regulatory Disclosure of AI Use: The Case of Drug Discovery and Development
In the last few years, AI’s technological frontier has moved forward substantially. Popular public commentary has often focused on the promise and perils of text and art produced by generative AI. But predictive and generative AI are also changing the world of technological innovation. That said, AI systems have not advanced to the point where they have their own incentives or where they have dramatically reduced the ratio of innovation cost to copying cost across all sectors. Accordingly, systems of innovation incentives like intellectual property, public funding, and (less intuitively) the information production incentives created by risk regulation still have a role to play.
I focus here on how these incentive systems can promote not only innovation and but also appropriate disclosure and hence accountability with respect to AI use. My specific focus is AI use in contexts where the immediate target of regulatory assessment is not the AI system per se but an output that emerges from the system.
Colloquia Discription
In the context of technology, how can the law promote abundance, efficiency, and access while also advancing values like fairness, safety, and privacy? What institutional arrangements and governance structures best support the consistent and equitable application of the law? And what empirical and legal theoretical insights can be leveraged to explain or improve the development and operation of technology law and policy? In this colloquium, we will explore these and related questions through the lens of seven projects, whose subject matter will draw from intellectual property, telecommunications, and related bodies of technology law.
