A lawsuit to force U.S. Immigration and Customs Enforcement to disclose records about its collection of data on some 200,000 immigrants through its SmartLINK App.

On behalf of Community Justice Exchange, Just Futures Law, and Mijente Support Group, the Samuelson Clinic filed suit to force U.S. Immigrations and Customs Enforcement (“ICE“) to disclose records about its collection of data on some 200,000 immigrants through its SmartLINK App.

Some 200,000 people are enrolled in ICE’s Intensive Supervision and Appearance Program (“ISAP“). Of these, nearly 150,000 are required to install the SmartLINK App. Yet little is known about the application, including what data ICE collects, how long it keeps that data, what use it makes of it and the extent to which it shares the data with others.

In September 2021, the immigrants rights groups filed a Freedom of Information Act request with ICE seeking records regarding SmartLINK. ICE never responded to the request.

In April 2022, the Samuelson Clinic filed suit on behalf of the three groups in United States District Court for the Northern District of California.

The clinic obtained a court order requiring ICE to release documents responsive to the request. After ICE complied, the plaintiffs voluntarily dismissed the case.
