Chris Hoofnagle, privacy expert and senior staff attorney with the Samuelson Law, Technology and Public Policy Clinic at UC Berkeley, agreed that, in addition to a dozen state and federal laws curbing pretexting, corporations will be much less likely to push legal boundaries when conducting investigations.
“These investigations used to be performed with impunity,” he said. “Now an organization has to think twice about the potential blowback from investigating journalists and others who have a right to free speech and should not be harassed.”
